1. VWOWGIFTS LIMITEDowns and operates VWOWGIFTS.COM, and VWOWGIFTS.COM.HK.
2. The user who logs on to this website agrees to the terms of use of VWOWGIFTS LIMITED.
3. VWOWGIFTS LIMITEDreserves the right to update these Terms of Use as necessary, and any changes will be effective immediately.

CUSTOMER SECURITY AND PRIVACY

i. VWOWGIFTS LIMITED has your consent to collect and use some of your personal information when using our websites. The information collected is strictly limited to the purpose of processing orders and improving the customer experience.

ii. Customer information may be shared with third parties as necessary to process the order.

iii. Under no circumstances will the customer's personal information be shared with third parties for commercial purposes.

iv. Customers may choose to remain anonymous when purchasing and sending gifts. However, successful electronic transactions require the gift giver's personal information, which could be shared under certain circumstances.

v. Customers' financial information is not stored through cookies.

PROMOTIONAL MATERIALS

Customers of VWOWGIFTS LIMITED will be notified from time to time by e-mail, fax or mail of the latest product information and promotions. Customers who prefer not to be disturbed may unsubscribe from the service by emailing info@vwowgifts.com.hk.

PRICES AND TRANSACTIONS

1. Prices on the Websites are applicable to all transactions, except for bulk orders, which may be subject to a special discount.
2. Prices of all products are quoted in Hong Kong dollars.
3. All prices quoted on the Websites do not include the cost of shipping, delivery or transportation. Charges for these services will be indicated prior to payment or in billing statements.
4. Refunds requested by the customer can only be made to the PayPal or credit card account used to purchase the items. For security reasons, VWOWGIFTS LIMITEDwill not refund with cash or checks, nor will we transfer funds to a third-party account.

SUBSTITUTION POLICY

i. Items listed on the VWOWGIFTS LIMITEDwebsite must match the online product images and descriptions. However, due to seasonal and market fluctuations, supply shortages may occur.

ii. VWOWGIFTS LIMITED reserves the right to substitute items not in stock with items of equal or higher quality. VWOWGIFTS LIMITED reserves the right to replace or exchange products when necessary. We will ensure that a replacement product is of equal or greater value and quality.

 DISCOUNT TERMS

1. Prices of all discounted products do not include shipping and delivery service, please refer to local freight rates.
2. Online and offline discounts or gift vouchers cannot be used at the same time or for the same purchase.
3. Product discounts are valid only during the promotion and cannot be applied to a previously paid purchase. Discounts can only be applied prior to checkout or payment.
4. The discount terms set forth in this Agreement may apply together or within the individual discount terms.

DELIVERY CONDITIONS

1. Information about the price of the products, shipping costs and total amount will be displayed before checkout.
2. Customers who do not choose to have the products delivered on the day of purchase may choose their preferred delivery time, which must be announced 24 hours in advance. The normal delivery time on the same day of purchase is between 16:00 and 18:00. However, if traffic conditions or other events cause a delay in delivery, the customer will be notified by the company's customer service department.
3. VWOWGIFTS LIMITED is not responsible for non-delivery if delivery delays or failures are caused by the following:

i. The recipient is unable to sign for the delivery at the specified delivery address and within the time frame for delivery.

ii. The delivery address is inaccurate or invalid.

iii. The recipient information is insufficient to complete delivery.

iv. The recipient's phone number is incorrect or invalid.

4. If customers want gifts delivered within a specific time period or within a narrow window of time, please call Customer Service at (852) 3481 2772at least 24 hours in advance. We may not be able to accommodate special requests due to limited delivery resources.
5. Specifying Delivery Time - A minimum of 24 hours’ notice is required to specify a specific delivery time. Requests made within 24 hours of delivery will be honored to the best of our ability, but without guarantee. If an additional delivery fee is required, it will be borne by the customer. For delivery inquiries, please contact our Customer ServiceDepartment at (852) 3481 2772.
6. If delivery is unsuccessful due to unavailability of the consignee or inaccurate delivery information, the customer will be responsible for all additional delivery charges.

For perishable items, VWOWGIFTS LIMITED cannot guarantee their quality due to extended delivery times. If fresh items must be repackaged for re-delivery, an additional charge of 80% of the original order value plus shipping charges will apply.

Due to weather or traffic conditions, undelivered or non-deliverable products, including perishable goods, will be returned to the same address within 24 hours at no charge.

7. A minimum charge of $150 per order will be applied for redirecting an order.

9. VWOWGIFT LIMITED’s existing service area is limited to the Hong Kong territory only. However, we will soon expand our business to other regions and cities outside the Hong Kong region.

COMPLAINTS POLICY

1. Perishable products, such as fruits, cannot be refunded once they have been delivered. To complain about fruit, food, beverages and other perishable items or damaged gifts, please contact our customer service department within 24 hours of receiving the VWOWGIFTS. Calls / Whatsapp made outside of business hours and on holidays will be answered by our customer service department on the following business days.
2. VWOWGIFTSreserves the right to request photos of the original product(s) and collect the original products for quality control purposes.

CANCELLATION POLICY

i. To cancel an order of fruit, food, beverage and/or other perishable items, please do so 48 hours prior to the delivery date. Failure to do so will result in an administrative charge of HK $150. Orders for fruit, food, beverages and other products that have already been packed or shipped cannot be canceledand the customer must pay the full price of the original order.

ii. Orders for non-perishable products may be cancelled at least 24 hours prior to the delivery date. If the cancellation is made within 24 hours prior to the delivery time, shipping charges will be deducted from the refund.

iii. If you wish to cancel an order, please call Customer Service at (+852) 3481 2772 or send an email to: info@vwowgifts.com and include the order number.

iv. In accordance with the Pricing and Transaction Policy (6), refunds will only be made to the PayPal account or credit card used by the customer to pay.

CHANGE & AMENDMENTS OF ORDERS

i. Change of order must be made at least 48 hours before delivery.

ii. If the price of the replacement product is lower than the original product, the price difference will not be refunded in any way.

iii. Changes or/and additions cannot be made to orders that are in process, in preparation and/or in delivery.

iv. Additional fees and charges may apply if an order is modified and/or amended.

v. If the price of the replacement product is lower than the original product, the price difference will not be refunded.

vi. VWOWGIFTS LTDreserves the right to refuse any changes or additions to the order.

RETURN CONDITIONS AND PROCEDURES

i. This clause does not apply to all fruits, foods, beverages and/or other perishable items. We will not be able to refund, return or exchange packaged products or products included in the shipment.

ii. For a full refund, the gift must not be damaged or stained in any way and the original packaging must be intact. Incomplete items with damaged packaging will not be eligible for a successful refund.

iii. If we receive the returned merchandise 5 days after delivery or a refund notification, we may refuse to accept the returned merchandise.

iv. All refunds for orders placed online or by phone will be credited to the original credit card or PayPal account used by the customer to pay within 5days prior to purchase. Cash refunds are not available.

REFUNDS  

Under the terms of the Merchandise Quality Policy (15), all discounted merchandise and promotional items are non-refundable unless they are in unacceptable condition. To receive a full refund, damaged merchandise must be returned within 5days of delivery.

THE QUALITY OF GOODS

We are committed to providing our customers with high quality products. However, we recognize that on rare occasions, products may be delivered with any defects. If customers receive products with damage, stains, or other quality issues, you may return the product within 5days of signing or gifting for a refund. VWOWGIFTSLIMITED reserves the right to ask customers to take photos of the original product(s). We may also require you to pick up the original products for quality control.

NON-REFUNDABLE OR RETURNABLE PRODUCTS.

Due to health and safety concerns, VWOWGIFTSwill not accept returns and refunds of the following products unless the product has express quality issues:

- perfume and soap

- cosmetics

- garments (both for men and women)

- perishable products

- food products

- beverages (including alcoholic beverages)

- personal care products

- fine ornaments

- hosiery

FRESH FOOD QUALITY

i. VWOWGIFTShas a strict selection standard and process to personally select fresh fruits, foods and beverages of the highest quality. However, these products are natural and perishable products that are susceptible to changes in indoor and outdoor environmental conditions, resulting in a shortened shelf life.

ii. To ensure that fresh food products have a longer shelf life, we recommend that they be stored in the best possible conditions, such as in the refrigerator or other cool places. We advise our customers not to expose fresh food to direct sunlight, high temperature and air conditioning for a long period of time as this will affect its quality. VWOWGIFTScannot guarantee the shelf life of fruits and perishable foods after delivery as they are susceptible to environmental changes.

iii. As fruits are natural products, color, size and availability may vary due to environmental and weather changes. Please note that all product images on this website are for reference only. VWOWGIFTS will endeavor to select the products with the best possible quality that is closest to the illustrations.

iv. Fruit, beverages and other perishable products cannot be returned or refunded unless the goods received are defective. If you have any questions, please contact Customer Service at (852) 3481 2772. VOWGIFTSLIMITED reserves the right to address questions and provide feedback on a case-by-case basis.

OUR 100% SATISFACTION WARRANTY

If you are not satisfied with the product, please call us within 24 hours of receipt and we will send you a replacement product of equal value as soon as possible.

Our satisfaction guarantee does not apply to merchandise that has been delivered late, replaced, or handled improperly by the customer. Our warranty applies only to the replacement of the same product and no refunds will be given for claims under our 100% satisfaction guarantee.

In the event of any discrepancy between the Chinese and English versions of the Terms and Conditions, the English version shall prevail.

TRADEMARKS, COPYRIGHT AND RESTRICTIONS

VWOWGIFTS LIMITED is the sole owner of all materials, including graphics, icons, text, electronic downloads, audio, data and software owned, operated, controlled or licensed by VWOWGIFTS LIMITED. All such materials may not be copied, reproduced or redistributed for commercial purposes without the prior written consent of VWOWGIFTS LIMITED.

FRAUD

i. It is prohibited to use the websites of VWOWGIFTS LIMITEDor the content contained therein for any illegal activity, including fraud, otherwise civil and/or criminal proceedings may be initiated.

ii. Placing orders under a false name, with a fraudulently obtained credit card or without the cardholder's consent is illegal. Those who have placed a fraudulent order may be subject to criminal prosecution.

DISCLAIMER

Limitation of Liability:

To the fullest extent permitted by law, and notwithstanding anything contained herein, the liability of VWOWGIFTS LIMITED shall be limited to the following:

- With respect to goods, to the replacement of the goods, the delivery of equivalent goods, the payment of the cost of replacing or repairing the goods, or the payment of the cost of obtaining equivalent goods; and

- With respect to Services, the re-performance of the Services or payment of the cost of re-performing the Services.

VWOWGIFTS LIMITED makes no warranty that this website, the information or ideas presented on this website, and/or the products or services will meet your requirements. It is intended that this limitation applies to any liability or cause of action, however alleged or arising, except to the extent prohibited by law.

By using this website, customers acknowledge that they will not hold VWOWGIFTS LIMITED liable for any direct, indirect, incidental, special or consequential damages arising from purchases made on our website, nor for any lost profits, revenue or contracts.
